1. General
The following standard contract terms shall apply to all deliveries and offers of SplitFish.de. Counter-confirmations of the buyer with reference to its own standard or sales terms and conditions are hereby objected to. Any deviations to these standard terms shall only be effective if SplitFish.de has confirmed such deviations in writing. The laws of the Federal Republic of Germany shall exclusively apply

3. Offer and Object of the Contract
The offers on our webside www.SplitFish.de  shall not be binding in relation to performance, quantity and collateral performance. The offer regarding quantity of supply shall be limited to the inventory on hand and is made in the form of a non-specific obligation limited by individual contract. We hereby expressly reserve the right to make technical modifications.

4. Prices
Our prices shall be those referred to in our product basket on our website at the time of order. Prices that deviate from this, which may be seen on pages that were downloaded from intermediate storage facilities, may not be current and are thus invalid. All prices are included 19% tax. Discounts can be only given, due to written agreements.

5. Terms of delivery
To place a order you need to order at a minimum amount of 20,- €. Bills of exchange or cheques shall only be accepted as payment for additional orders if the order is less then the minimum amount.

6.Payment
We accept payment in advance only. Unless otherwise agreed, all invoices by SplitFish.de shall be payable immediately without any deductions. In the event of default of payment, SplitFish.de shall be entitled to charge interest of at least 5 percentage points above the applicable base rate
contained in the Discount Rate Transfer Act. In case a reminder compute we are entiteled to charge a 10 euro fee per reminder. Any set-off of counterclaim shall not be permitted unless proven at law or if accepted by SplitFish.de. The retention of payments by the purchaser for counterclaims resulting from unrelated contracts shall be excluded Other agreements require written permissions.

7. Rights of lien
The right is entitled to the customer only if its counterclaims are validly
determined or undisputed. For the practice of a right of lien the customer
is only to that extent authorized, when its counterclaim is based on the
same contractual relation.

8. Period of Delivery
The delivery periods are dependent if the customer comes into default of acceptance or hurts other obligations of the order, SplitFish will be entitled thereby to claim from the customer the damages including any multi-expenditures. Additional requirements remain reserving. It remains
proving to the customer for his part that a damage in the required height did not develop at all or at least substantially lower. The beginning of the delivery time indicated by us presupposes the punctual and normal fulfilment of the obligations of the customer. The objection of the not fulfilled contract remains reserving for us. In the event that delivery is impossible, without this being the responsibility of anyone, Respawn3D GmbH shall be entitled to terminate the contract. The customer shall not be entitled to damages as a result thereof.

9. Passage of risk and warranties
The warranty period shall begin at the time when the goods are delivered. The statutory warranty provisions shall apply. Provided that the customer is the consumer, the periods of limitation for statutory claims for defects shall be two years. If the customer is a merchant the limitation period for warranty claims is one year.SplitFish.de shall not be liable for normal wear
and tear of the good or defects which are a result of incorrect or negligent handling or treatment or which are caused by unusual conditions of use. If the delivered item has been repaired or modified by the customer or by a third party without written approval by SplitFish.de, all warranty rights shall expire. Obvious, as well as covered transport damages are to be announced to the transportation person or has to be criticized and logged within seven days at the local post office branch. With substantial transport damages the acceptance of the commodity is to be refused. With each notice of defect has the customer to send back the commodity in the
original packaging or an accordingly suitable packing with complete accessories as well as a copy of the delivery note.The package that needs to be send back by the customer, has to be sufficiently franked or will be refused. With justified complaint the postage costs are refunded by bank credit transfer. Small deviations of the object of the purchase or its components concerning quality, color, form etc. do not represent lack, as far as these are reasonable commercial standard and suitability for the customer.

10. Retention of title
We reserve ourselves the property of the commodity up to the complete payment and reconciliation of all demands from the supply contract, supplied by us. This applies also to conditioned demands. As long as the property did not change over yet, the customer has to inform us immediately in writing, if the supplied article is exposed or seized to a third party.

11. Revocation and Obligation to return the Goods
The customer may revoke his/her declaration to conclude a sales contract within a period of two weeks in textual form without stating a reason or by returning the goods . The term commences upon receipt of the goods. The timely despatch of the revocation or the goods shall be deemed sufficient for compliance with the revocation term. A return must take place freely. Exception: Any returns of DVD´s shall only be accepted if the items are sealed and not before opened .

12. Foreign country
Respawn3D exclusively supplys to European Union countries only. Deviating agreements require a written confirmation. Orders outside of the European Union are passed on at www.SplitFish.com.

13. Area of jurisdiction
It exclusively applies the right of the Federal Republic of Germany.

14. Final clauses
In the event that one or several of the above provisions is or becomes invalid, the validity of the remaining provisions shall not be affected. Invalid provisions shall be replaced by such provisions which are valid and come closest to the commercial purpose intended by the parties. Changes or additions of these general trading conditions require a written form.
